Montgomery County deputies arrest assistant county attorney for DUI

MONTGOMERY COUNTY, Kan. — The Montgomery County Sheriff’s Office (MCSO) said they arrested 65-year-old Daylene Walls, the assistant county attorney for juvenile matters, on charges of driving under the influence, battery on a law enforcement officer, and interference with a law enforcement investigation.

MCSO also arrested Walls friend, 75-year-old Steven Simmons, on the charge of interference with a law enforcement investigation.

MCSO said patrol deputies were called to U.S. Highway 160 and U.S. Highway 75 west of Independence, Kansas around 10:30p.m. after someone reported a vehicle in the ditch as well as reports of a woman stumbling out of the vehicle in the ditch and of another stopped vehicle.

When deputies arrived a few minutes later they found Walls and Simmons at the scene and found evidence that Walls was under the influence of alcohol.

MCSO said deputies attempted to conduct their investigation of DUI, but Walls would not comply and then refused to place her hands behind her back when they attempted to arrest her for suspicion of DUI.

MCSO said at one point Walls slapped the Deputy and repeatedly told them she was not going to jail but was later taken into custody without any further incident.

Deputies took Simmons into custody after he argued with them and tried to prevent Deputies from taking Walls into custody.

MCSO said a search warrant was obtained to test Walls blood to see if she was over the legal limit and later booked her into the jail.
